TERMS & CONDITIONS

1. By virtue of the present agreement, the person indicated in booking confirmation (hereinafter the “Guest”) concludes the apartment rental agreement for the purpose of short-term accommodation with NO HO SP. Z O. O. registered seat in Krakow, 24 Straszewskiego Str. apt. 6. (hereinafter the “Landlord”).

2. We have different locations as follow:
a. NOVUMHOUSE Straszewskiego (used to be called Novum House Apartamenty): 24 Straszewskiego Str. apt 6, 31-113 Kraków
b. NOVUMHOUSE (used to be called Novum House Tomasza): rooms are located at 26 Św. Tomasza str. apt 23 and Apartament is located at
31 Św. Tomasza Str. apt 14, 31-027 Kraków
c. NOVUMHOUSE Starowiślna (used to be called Imagine Apartments): 4 Starowiślna Str. apt 4, 31-032 Kraków Collectively known as NOVUMHOUSE

3. Prepayment and Payment: The price list is expressed in PLN, and payments in other currencies are converted according to the payment operator FISERV POLSKA S.A (owner of the POLCARD brand). The Guest makes a prepayment or payment online on the Guest Platform at alfred.previo.app available also at novumhouse.pl/alfred, according to the terms and time frame agreed upon during the reservation process. The payment operator is FISERV POLSKA S.A (owner of the POLCARD brand). Previously calculated discounts do not apply to payments made using a stationary terminal or in cash, and purchasing the Concierge service is necessary. If the Guest does not make the payment within the specified deadline, NO HO Sp. z O. O. has the right to charge the Guest using a MOTO transaction with the DCC method, and the Guest unconditionally and irrevocably agrees to this. At the same time, the Guest consents to the verification of the card and its holder during the stay. In case of incorrect verification, a refund will be issued and an on-site payment will be required before the check-in. Any unfounded chargebacks will incur a fee of 450 PLN.

4. Payment Policy and Debt Collection: All bills must be paid before check-out. If the Guest fails to make the payment, an email will be sent to the address provided at check-in, giving 24 hours to settle the outstanding balance. If the payment is not received within this period, the matter will be passed to a debt collection company, resulting in an additional charge of 450 PLN. If the debt remains unpaid, legal action will be taken, with potential court and legal fees amounting up to 25 000 PLN. Additionally, statutory interest for late payment will be charged from the check-out date.

5. The room or apartment is rented for rental days. Price is for a room for number of persons shown on booking confirmation. For an extra adult person in the room there is additional fee 150 PLN per person per night. Check in time is 3:00 p.m., check out time is 11:00 a.m.

6. NOVUMHOUSE provides the following services within the rental price: Internet access – WiFi or cable, every two days housekeeping at the times indicated by the Guest, fresh towels at the times indicated by the Guest. Additional services or products are charged additionally according to the price list. The price includes VAT.

7. The Guest receives access to the room or apartment through a coded key card and the code. The card or code is active until 11:00 pm of the last day of the stay.

8. NOVUMHOUSE processes the Guest’s personal data solely for the purposes of performing hotel services, including researching opinions on the rendered services. The Guest’s information will not be disclosed to any other entities.

9. NOVUMHOUSE is liable for the loss or damage of objects brought in by the persons using her services, in the extent indicated by the provisions of Article 846-849 of the Civil Code. The Guest should inform the hotel reception on the occurrence of damage immediately after its ascertainment.

10. The liability of the NO HO SP. Z O. O. on account of the loss or damage of money, securities, valuables or objects being of academic or artistic value shall be limited, if these objects are not deposited at the hotel reception desk. The Facility is not liable for the damage or loss of a car or other vehicle belonging to the Guest.

11. All the objects found in the rooms or apartment and common areas are the property of the hotel and may not be taken outside the building. In the event of the ascertainment of any object after the Guest’s checkout, the NO HO SP. Z O. O. has the right to encumber the Guest with the equivalent of its cost according to the price list, found at the reception desk.

12. The Guest bears full substantive liability for all types of damages or destruction to the furnishings and technical equipment which occurred due to his fault, or the fault of the guests visit him.

13. Persons not checked into the room or apartment may be in the room from 8:00 a.m. to 10:00 p.m.

14. Quiet hours are in force in the apartment from 10:00 p.m. to 8:00 a.m. Due to the fact that the rental facility is located in a residential tenement building, disturbing the peace at night may result in the immediate order to vacate the room, with the maintenance of the obligation to pay for the entirety of the visit.

15. By prior arrangement with reception staff we do allows pets for additional costs according to the price list. Not applicable in NOVUMHOUSE Starowiślna where pets are not allowed.

16. The ban on smoking is in force in the rooms, common areas as well as balcony and the stairwell. In the case of the ascertainment of smoking in the above-mentioned areas, NOVUMHOUSE shall encumber the Guest with a one-time additional fee of PLN 1000.

17. Any personal belongings left by the guest upon leaving the apartment shall be mailed to the Guest’s permanent residency address, at the guest’s request and expense.

18. For all the services and goods provided in the NO HO SP. Z O. O. it is possible to obtain an invoice. According to the Polish Low the guest needs to ask for the invoice when making the reservation. The invoice will be issued in an electronic form of a protected PDF file and sent form hello@novumhouse.pl to the Guest’s email address specified in the registration card or booking confirmation. NO HO SP. Z O. O. assures the authenticity of the origin and the integrity of the contents of the invoices sent electronically.

Dear Sir/Madam,
In relation to local hotel-related services for our guests (catering, access to utilities/media, accommodation, cleaning, security and CCTV in the NOVUMHOUSE, the Controller of your personal data is NO HO Sp. z o. o., with its legal address at ul. Straszewskiego 24/6, 31-113 Krakow. Personal data of our hotel Guests are processed for the purposes of performing the hotel service agreement. This, the legal grounds for the personal data processing is Art. 6 p. 1 letter b of the European Parliament and Council Regulation of 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as the Regulation). Personal data may be received by the legal counsel’s firm, the company responsible for security at our hotel (Justus), Profitroom (if you used this company’s agency service). Our Guests’ data are stored during their stay at the hotel and after the stay for the period within which it is possible to seek claims, which the Civil Code stipulates to be 10 years. Financial settlement details are archived in compliance with the fiscal regulations for 5 years after the end of the accounting settlement period has finished. In this case, the data shall be processed under Art. 6 p. 1 letters c and f of the Regulation, i.e. in relation to due performance of legal requirements and legally justified interests of the NO HO Sp. Z O. O. company. The Guests have the right to request access to their personal data from the NO HO Sp. z o.o., as well as to transfer and correct such data and, in justified cases, to limit data processing. Moreover, we would like to inform you that due to the Regulation you have a right to file a complaint with the supervisory authority. The necessity to collect basic personal data of Hotel Guests for the purpose of performance of hotel services results from the provisions of the Civil Code Act which requires that all the Parties to an agreement be precisely stated. NO HO Sp. z o.o. does not subject the Subscribers’ data to automatic decision-making, including profiling, which could result in legal effect for the Subscribers or affect them significantly.
